If we make significant changes to a tour, we will notify you as soon as possible and offer the same options. We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.
We strongly recommend that you purchase comprehensive travel insurance at the time of booking to protect yourself against unforeseen circumstances that may result in cancellation or interruption of your trip, medical emergencies, and other travel-related issues.
You are responsible for ensuring that you have a valid passport with at least six months validity beyond your return date and any necessary visas for all countries included in your itinerary. We will provide general information about passport and visa requirements, but it is your responsibility to check with the relevant embassies or consulates.
You are responsible for complying with any health requirements or recommendations for your travel destinations, including vaccinations and medications. We recommend consulting with a travel medicine specialist or your doctor for advice on health precautions.
We are not responsible if you are denied entry to any country because of your failure to carry the correct and adequate passport, visa, or other travel documents required by any immigration, police, customs, or health authorities.
On guided tours, the tour leader or guide has the authority to make decisions for the safety and well-being of the group. You must comply with any reasonable direction given by the tour leader or guide.
You must behave responsibly and show consideration for others. We reserve the right to terminate your participation in a tour if your behavior is, in our opinion or that of our tour leaders or supplier partners, causing distress, damage, danger, or annoyance to others. In such cases, no refunds will be given, and you will be responsible for your own repatriation and related costs.
You must comply with all local laws and regulations of the countries you visit during your tour. We are not responsible for any consequences arising from your failure to comply with local laws and regulations.
Our tours may require a reasonable level of fitness and mobility. You must notify us at the time of booking if you have any medical or physical condition that may affect your ability to participate in the tour or require special assistance. We reserve the right to refuse a booking or cancel your participation if we believe that your health or physical condition may endanger yourself or others.
We will arrange and coordinate the services that make up your tour with reasonable skill and care. We accept responsibility for any loss or damage you suffer as a result of our negligence or that of our employees, agents, or suppliers, acting within the scope of their employment or agency.
We are not responsible for any failure to perform our obligations under these Terms and Conditions due to events beyond our reasonable control, including but not limited to war, civil unrest, terrorist activities, industrial disputes, natural disasters, adverse weather conditions, epidemics, or technical problems with transportation or infrastructure.
Our liability to you for any loss or damage suffered by you in connection with your tour is limited to three times the price of your tour. This limitation does not apply to cases involving death, personal injury, or fraud.
We act as an agent for third-party service providers (e.g., hotels, transport operators, local tour operators) and are not responsible for the acts or omissions of these third parties. Your contract for these services will be with the third-party provider, and their terms and conditions will apply.
We are not responsible for any excursions, tours, or activities that you arrange independently during your tour, even if our tour leaders or representatives recommend these activities.
All content on our website, including text, graphics, logos, images, and software, is the property of GoSmoknaut or our content suppliers and is protected by Australian and international copyright laws. You may not reproduce, modify, distribute, or republish any content from our website without our prior written consent.
We collect and process your personal information in accordance with our Privacy Policy.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms and Conditions, together with our Privacy Policy and any other written agreement between you and us, constitute the entire agreement between you and us regarding your use of our website and services.
These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
