Welcome to GoSmoknaut. These Terms and Conditions govern your use of our website and services, including booking tours and travel packages. By accessing our website or using our services, you agree to be bound by these Terms and Conditions.

Please read these Terms and Conditions carefully before making any booking or using our services. If you do not agree to these Terms and Conditions, please do not use our website or services.

Definitions

In these Terms and Conditions, unless the context otherwise requires:

  • "We," "our," or "us" refers to GoSmoknaut, an Australian registered company.
  • "You" or "your" refers to the person accessing our website, making a booking, or using our services.
  • "Services" refers to the travel services provided by us, including tours, accommodations, transportation, and other related services.
  • "Booking" refers to the reservation of any tour, accommodation, or other travel services through our website, by phone, email, or in person.
  • "Tour" refers to any travel itinerary, package, or excursion provided by us.
  • "Website" refers to the GoSmoknaut website at www.gosmoknaut.com and all associated domains.

Booking and Payment

Booking Process

To make a booking, you must:

  • Complete the booking form on our website, or submit an inquiry via email, phone, or in person.
  • Provide accurate and complete information, including your full name as it appears on your passport, date of birth, contact details, and any special requirements.
  • Pay the required deposit or full payment as specified at the time of booking.
  • Accept these Terms and Conditions.

Booking Confirmation

A binding contract between you and us will come into existence when we send you a booking confirmation. We reserve the right to decline any booking at our discretion.

Deposit and Payment Schedule

Unless otherwise specified at the time of booking:

  • A non-refundable deposit of 20% of the total tour cost is required to secure your booking.
  • The remaining balance must be paid no later than 60 days before the departure date.
  • For bookings made within 60 days of departure, full payment is required at the time of booking.
  • For certain promotions or special offers, different payment terms may apply.

Payment Methods

We accept payment by credit card (Visa, MasterCard, American Express), bank transfer, and PayPal. All payments must be made in Australian Dollars (AUD).

Price Guarantee

Once your booking is confirmed and you have paid your deposit, the price of your tour will not change unless you make changes to your booking or there are significant currency fluctuations, increases in government taxes, or fuel surcharges.

Cancellations and Changes

Cancellation by You

If you need to cancel your booking, you must notify us in writing. The following cancellation fees will apply:

  • More than 60 days before departure: loss of deposit
  • 59-30 days before departure: 50% of total tour cost
  • 29-15 days before departure: 75% of total tour cost
  • 14 days or less before departure: 100% of total tour cost

Changes to Your Booking

If you wish to make changes to your booking (e.g., change of departure date, tour, or accommodation), we will do our best to accommodate your request but cannot guarantee that changes will be possible. The following fees will apply:

  • More than 60 days before departure: $100 per person per change
  • 59-30 days before departure: $200 per person per change
  • 29 days or less before departure: changes treated as cancellation

In addition to our fees, you will be responsible for any price difference and third-party charges associated with the changes.

Cancellation or Changes by Us

We reserve the right to cancel or make changes to a tour for any reason, including insufficient participants, force majeure events, or safety concerns. If we cancel a tour, you may choose between:

  • A full refund of payments made to us
  • An alternative tour of equivalent or higher value at no extra cost
  • An alternative tour of lower value with a refund of the price difference

If we make significant changes to a tour, we will notify you as soon as possible and offer the same options. We are not responsible for any incidental expenses you may have incurred as a result of your booking, such as visas, vaccinations, or non-refundable flights.

Travel Insurance

We strongly recommend that you purchase comprehensive travel insurance at the time of booking to protect yourself against unforeseen circumstances that may result in cancellation or interruption of your trip, medical emergencies, and other travel-related issues.

Passports, Visas, and Health Requirements

Passports and Visas

You are responsible for ensuring that you have a valid passport with at least six months validity beyond your return date and any necessary visas for all countries included in your itinerary. We will provide general information about passport and visa requirements, but it is your responsibility to check with the relevant embassies or consulates.

Health Requirements

You are responsible for complying with any health requirements or recommendations for your travel destinations, including vaccinations and medications. We recommend consulting with a travel medicine specialist or your doctor for advice on health precautions.

Entry Denials

We are not responsible if you are denied entry to any country because of your failure to carry the correct and adequate passport, visa, or other travel documents required by any immigration, police, customs, or health authorities.

During Your Tour

Tour Leader Authority

On guided tours, the tour leader or guide has the authority to make decisions for the safety and well-being of the group. You must comply with any reasonable direction given by the tour leader or guide.

Behavior and Conduct

You must behave responsibly and show consideration for others. We reserve the right to terminate your participation in a tour if your behavior is, in our opinion or that of our tour leaders or supplier partners, causing distress, damage, danger, or annoyance to others. In such cases, no refunds will be given, and you will be responsible for your own repatriation and related costs.

Compliance with Local Laws

You must comply with all local laws and regulations of the countries you visit during your tour. We are not responsible for any consequences arising from your failure to comply with local laws and regulations.

Participation Requirements

Our tours may require a reasonable level of fitness and mobility. You must notify us at the time of booking if you have any medical or physical condition that may affect your ability to participate in the tour or require special assistance. We reserve the right to refuse a booking or cancel your participation if we believe that your health or physical condition may endanger yourself or others.

Liability and Responsibility

Our Responsibility

We will arrange and coordinate the services that make up your tour with reasonable skill and care. We accept responsibility for any loss or damage you suffer as a result of our negligence or that of our employees, agents, or suppliers, acting within the scope of their employment or agency.

Force Majeure

We are not responsible for any failure to perform our obligations under these Terms and Conditions due to events beyond our reasonable control, including but not limited to war, civil unrest, terrorist activities, industrial disputes, natural disasters, adverse weather conditions, epidemics, or technical problems with transportation or infrastructure.

Limitation of Liability

Our liability to you for any loss or damage suffered by you in connection with your tour is limited to three times the price of your tour. This limitation does not apply to cases involving death, personal injury, or fraud.

Third-Party Services

We act as an agent for third-party service providers (e.g., hotels, transport operators, local tour operators) and are not responsible for the acts or omissions of these third parties. Your contract for these services will be with the third-party provider, and their terms and conditions will apply.

Excursions and Activities

We are not responsible for any excursions, tours, or activities that you arrange independently during your tour, even if our tour leaders or representatives recommend these activities.

General Provisions

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of GoSmoknaut or our content suppliers and is protected by Australian and international copyright laws. You may not reproduce, modify, distribute, or republish any content from our website without our prior written consent.

Privacy

We collect and process your personal information in accordance with our Privacy Policy.

Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other written agreement between you and us, constitute the entire agreement between you and us regarding your use of our website and services.

Governing Law

These Terms and Conditions are governed by the laws of New South Wales, Australia. Any dispute arising from these Terms and Conditions will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
